A Manitoba-based business has been ordered to cease operating in Ontario or face prosecution.
The Bereavement Authority of Ontario has learned that the funeral establishment, Ethical Death Care, 530 St. Mary Ave., Winnipeg, is advertising and/or providing services in Ontario without a licence as required by law, Ontario’s Funeral, Burial and Cremation Services Act, 2002 (FBCSA).
Ethical Death Care is not currently licensed under the FBCSA. Therefore, it is not permitted to offer licensed services in Ontario. The company has been ordered to immediately cease selling or offering to sell licensed services in the province of Ontario.
Should it fail to comply, the Registrar of the FBCSA may prosecute the company for an offence under the FBCSA.
Penalty
The penalty for each offence an individual is convicted of under the FBCSA is a fine of up to $50,000, imprisonment for a term of up to two years less a day, or both. A corporation that is convicted of an offence under the FBCSA is liable for a fine of up to $250,000.
The cease order has also been communicated to Manitoba’s Consumer Protection and Government Services, so they may monitor and regulate Ethical Death Care’s professional suitability to carry on the business of a funeral director.

The Bereavement Authority of Ontario (BAO) is a government delegated authority and not-for-profit corporation administering provisions of the Funeral, Burial and Cremation Services Act, 2002 (FBCSA) on behalf of the Ministry of Public and Business Service Delivery. Responsible for protection of the public interest, the BAO regulates and supports licensed:
- Funeral establishment operators, directors and preplanners;
- Cemetery, crematorium and alternative disposition operators;
- Transfer service operators; and
- Bereavement sector sales representatives across Ontario.
The BAO is wholly funded by licensee fees (not tax dollars).
