Notice of Discipline: Derek Dwayne Maschke

Update – June 6, 2023
A Discipline hearing was held on August 17 and 18, 2022. On November 30, 2022 the Panel found Mr. Maschke failed to:
-Comply with the Registrar’s Directive and Order
-Abide by public health Orders and Registrar’s Directives
-Comply with reporting requirements
-Complete continuing education and provided false information to the BAO
A penalty hearing is set for June 8, 2023.

Notice of Proceedings: Discipline hearing
It is alleged that Derek Dwayne Maschke, of Napanee, has contravened the Code of Ethics, specifically sections 3 of Regulation 216/18 and sections 8(a), 8(s) and 8(u) under Ontario Regulation 32/11 formerly under the Funeral Directors and Establishments Act.  Maschke has the right to respond to the allegations in the notice at a discipline hearing.

The Bereavement Authority of Ontario (BAO) has converted its proposal to immediately suspend and revoke the Funeral Director – Class 1 licence of Derek Dwayne Maschke, of Napanee, to a notice of discipline.  

Maschke is the sole proprietor of licensed funeral organizations in Napanee, Northbrook, and is a joint owner of one in Parham. The notice of discipline is against his personal licence only.

The BAO’s notice of discipline states that Maschke: 

• Failed to abide by Public Health Orders and Registrar’s Directives, re: COVID-19
  -Maschke has failed ensure that two funeral organizations follow public health guidelines regarding COVID-19 and Registrar’s Directives related to COVID-19.
• Failed comply with with an Order from the Registrar
  -The Registrar’s Directive, of Sept. 2, 2021, required all funeral establishment operators and transfer service operators to implement a vaccination policy at their establishments.
• Failed to comply with financial reporting requirements
  -Contrary to the Funeral, Burial and Cremation Services Act, 2002 (FBCSA).

Maschke has the right to appeal the notice to the Discipline Committee.

The Discipline Committee is empowered to make decisions on alleged breaches of the Code of Ethics. Where the Registrar believes a licensee has breached the Code, the Registrar may require the licensee to appear before the Discipline Committee for a review of the licensee’s conduct. The Code requires all licensees conduct business professionally and competently.
