Proposal to Revoke: Toronto Muslim Cemetery Corporation

Update as of Dec. 13, 2022:
On May 10, 2022 the Licence Appeal Tribunal (LAT) upheld the Registrar’s proposal to revoke the cemetery licence of TMCC. Since then, TMCC appealed the decision by making a request to Divisional Court for Judicial Review of the LAT Order. On Dec. 13, 2022, the Registrar and TMCC came to an agreement to licence TMCC on conditions, after which TMCC withdrew its application to Divisional Court to appeal the LAT decision.

The Bereavement Authority of Ontario (BAO) has issued a proposal to revoke the cemetery operator licence of Toronto Muslim Cemetery Corporation, at 13076 Leslie St. in Richmond Hill.

If the proposal is successful, TMCC and any delegates acting on behalf of TMCC will not be able to legally operate, sell or offer to sell licensed supplies and services related to a cemetery in Ontario.

The BAO has taken this action to protect grieving families, who are consumers of the bereavement sector.

The BAO’s notice of proposal states that TMCC has:  

• Failed to comply with a Court order that required TMCC to issue interment rights certificates to Muslim Green Cemetery Corporation (“MGCC”) pursuant to a contract TMCC and MGCC made.
• Failed to comply with directives from the Registrar requiring TMCC and MGCC to resolve their dispute, and for TMCC to issue the interment rights certificates.

Appeals process

Licensees are entitled to appeal suspensions and proposals to revoke licences by requesting a hearing with the Licence Appeal Tribunal within 15 days of receiving a notice or proposal. The tribunal would then determine whether the BAO’s order should continue and/or stand.

If the licensees do not request a hearing with the Licence Appeal Tribunal, the BAO will carry out the proposal.
