Good morning, <\/p>\n\n\n\n

I am writing to advise you that the Ministry of Government and Consumer Services has posted a consultation paper on Ontario\u2019s Regulatory Registry that may be of interest to you. <\/p>\n\n\n\n

On December 7th<\/sup>, the Auditor General released her 2020 Annual Report, which included a value-for-money audit of the BAO<\/a> and the ministry\u2019s oversight of the BAO. The Auditor General recommended that the government consider potential legislative and\/or regulatory changes to address some of the concerns raised in the report.  

The consultation paper seeks feedback to inform potential proposals for changes to the Funeral, Burial and Cremation Services Act, 2002 (FBCSA) and\/or its regulations to address recommendations made by the Auditor General as well as concerns raised by stakeholders. The consultation paper seeks feedback on the following topics:<\/p>\n\n\n\n

  1. Consumer protection measures\n
      \n
    1. Transparency of price information<\/li>\n\n\n\n
    2. Disclosure requirements for promotional materials<\/li>\n\n\n\n
    3. Displaying the BAO logo<\/li>\n\n\n\n
    4. Upselling and\/or aggressive sales practices<\/li>\n\n\n\n
    5. Not allowing the licensing of new disposition technology providers until safety of the technology can be confirmed<\/li>\n<\/ol>\n<\/li>\n\n\n\n
    6. Compliance and enforcement tools<\/li>\n\n\n\n
    7. Priority of persons with legal authority to make decisions regarding decedents<\/li>\n\n\n\n
    8. Cemetery care and maintenance fund\/accounts (CMF\/As)\n
        \n
      1. Interest payment requirements on funds borrowed from the capital portion of cemetery CMF\/As<\/li>\n\n\n\n
      2. Potential to exempt municipal cemetery operators from CMF\/A requirements<\/li>\n<\/ol>\n<\/li>\n\n\n\n
      3. Other cemetery-related proposals\n

        1. Neglected or abandoned cemeteries<\/li>\n\n\n\n
        2. Cemetery closure process\u00a0<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n\n\n\n

          Le document de consultation sollicite des commentaires pour \u00e9clairer les \u00e9ventuelles propositions de modifications \u00e0 la Loi de 2002 sur les services fun\u00e9raires et les services d\u2019enterrement et de cr\u00e9mation<\/em> (LSFSEC) ou \u00e0 ses r\u00e8glements pour r\u00e9pondre aux recommandations formul\u00e9es par la v\u00e9rificatrice g\u00e9n\u00e9rale ainsi qu\u2019aux pr\u00e9occupations soulev\u00e9es par les intervenants. Le document de consultation sollicite des commentaires sur les sujets suivants :<\/span><\/p>\n\n\n\n

            6. Conformit\u00e9 et outils d\u2019application de la loi<\/li>\n
            7. Priorit\u00e9 accord\u00e9e aux personnes ayant l\u2019autorit\u00e9 l\u00e9gale de prendre des d\u00e9cisions concernant les d\u00e9funts<\/li>\n
            8. Fonds ou comptes d\u2019entretien d\u2019un cimeti\u00e8re (F\/CEC)\n
