Maschke avait omis de.. : <br>-de se conformer \u00e0 la directive et \u00e0 l&#8217;ordonnance du registraire<br>-de se conformer aux ordonnances de sant\u00e9 publique et aux directives du registraire<br>de se conformer aux ordonnances de sant\u00e9 publique et aux directives du registraire ; &#8211; de se conformer aux exigences en mati\u00e8re de rapports<br>-de suivre une formation continue et de fournir de fausses informations au BAO. <br>Une audience de sanction est pr\u00e9vue pour le 8 juin 2023.<\/p>\n\n\n<p class=\"has-background wp-block-paragraph\" style=\"background-color:#cee9f9\"><em>Mise \u00e0 jour &#8211; 11 mai 2022<\/em><br><strong>Avis de proc\u00e9dure<\/strong>: Audience disciplinaire <br>On all\u00e8gue que Derek Dwayne Maschke, de Napanee, a enfreint le Code de d\u00e9ontologie, en particulier l&#8217;article 3 du R\u00e8glement 216\/18 et les articles 8(a), 8(s) et 8(u) du R\u00e8glement de l&#8217;Ontario 32\/11, anciennement la Loi sur les entrepreneurs de pompes fun\u00e8bres et les \u00e9tablissements fun\u00e9raires.  M. Maschke a le droit de r\u00e9pondre aux all\u00e9gations contenues dans l&#8217;avis lors d&#8217;une audience disciplinaire.<\/p>\n\n\n<p class=\"wp-block-paragraph\">L&#8217;Autorit\u00e9 des cimeti\u00e8res de l&#8217;Ontario (ACO) a transform\u00e9 sa proposition de suspendre et de r\u00e9voquer imm\u00e9diatement le permis de directeur de fun\u00e9railles de classe 1 de Derek Dwayne Maschke, de Napanee, en un avis de mesures disciplinaires.  <\/p>\n\n\n<p class=\"wp-block-paragraph\">M. Maschke est l&#8217;unique propri\u00e9taire d&#8217;entreprises fun\u00e9raires autoris\u00e9es \u00e0 Napanee et \u00e0 Northbrook, et il est copropri\u00e9taire d&#8217;une entreprise fun\u00e9raire \u00e0 Parham. L&#8217;avis de mesure disciplinaire ne vise que son permis personnel.<\/p>\n\n\n<p class=\"wp-block-paragraph\">L&#8217;avis disciplinaire du BAO indique que Maschke : <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>N&#8217;a pas respect\u00e9 les ordonnances de sant\u00e9 publique et les directives du greffier concernant le COVID-19<\/strong><br>-M. Maschke n&#8217;a pas veill\u00e9 \u00e0 ce que deux organisations fun\u00e9raires respectent les directives de sant\u00e9 publique concernant le COVID-19 et les directives du bureau d&#8217;enregistrement relatives au COVID-19.<\/li>\n\n\n\n<li><strong>D\u00e9faut de se conformer \u00e0 une ordonnance du registraire <\/strong><br>-La directive du registraire du 2 septembre 2021 exigeait que tous les exploitants d&#8217;\u00e9tablissements fun\u00e9raires et de services de transfert mettent en \u0153uvre une politique de vaccination dans leurs \u00e9tablissements.<\/li>\n\n\n\n<li><strong>Non-respect des exigences en mati\u00e8re de rapports financiers<\/strong> <br>-Contrairement \u00e0 la <em>loi de 2002 sur les services de fun\u00e9railles, d&#8217;enterrement et de cr\u00e9mation (Funeral, Burial and Cremation Services Act, 2002) (FBCSA)<\/em>. <\/li>\n<\/ul>\n\n\n<p class=\"wp-block-paragraph\">Maschke a le droit de faire appel de la notification aupr\u00e8s du comit\u00e9 de discipline.<\/p>\n\n\n<p class=\"wp-block-paragraph\">La commission de discipline est habilit\u00e9e \u00e0 prendre des d\u00e9cisions sur les infractions pr\u00e9sum\u00e9es au code de d\u00e9ontologie. Lorsque le greffier estime qu&#8217;un titulaire de licence a enfreint le code, il peut demander \u00e0 ce dernier de se pr\u00e9senter devant la commission de discipline pour que sa conduite soit examin\u00e9e.
