Depuis lors, la TMCC a fait appel de la d\u00e9cision en demandant \u00e0 la Divisional Court un contr\u00f4le judiciaire de l&#8217;ordonnance du LAT. Le 13 d\u00e9cembre 2022, le registraire et la TMCC sont parvenus \u00e0 un accord pour octroyer une licence \u00e0 la TMCC sous certaines conditions, apr\u00e8s quoi la TMCC a retir\u00e9 sa demande d&#8217;appel de la d\u00e9cision du LAT aupr\u00e8s de la Divisional Court.<\/p>\n\n\n<p class=\"wp-block-paragraph\">L&#8217;Autorit\u00e9 des cimeti\u00e8res de l&#8217;Ontario (Bereavement Authority of Ontario &#8211; BAO) a \u00e9mis une proposition visant \u00e0 r\u00e9voquer la licence d&#8217;exploitant de cimeti\u00e8re de la Toronto Muslim Cemetery Corporation, situ\u00e9e au 13076, rue Leslie, \u00e0 Richmond Hill.<\/p>\n\n\n<p class=\"wp-block-paragraph\">Si la proposition est accept\u00e9e, la TMCC et tout d\u00e9l\u00e9gu\u00e9 agissant au nom de la TMCC ne pourront pas l\u00e9galement exploiter, vendre ou offrir de vendre des fournitures et des services autoris\u00e9s li\u00e9s \u00e0 un cimeti\u00e8re en Ontario.<\/p>\n\n\n<p class=\"wp-block-paragraph\">Le BAO a pris cette mesure pour prot\u00e9ger les familles en deuil, qui sont des consommateurs du secteur du deuil.<\/p>\n\n\n<p class=\"wp-block-paragraph\">L&#8217;avis de proposition du BAO indique que TMCC a.. :  <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>N&#8217;a pas respect\u00e9 une ordonnance du tribunal qui exigeait que la TMCC d\u00e9livre des certificats de droits d&#8217;inhumation \u00e0 la Muslim Green Cemetery Corporation (&#8220;MGCC&#8221;) conform\u00e9ment \u00e0 un contrat conclu entre la TMCC et la MGCC.<\/li>\n\n\n\n<li>N&#8217;a pas respect\u00e9 les directives du greffier demandant \u00e0 la TMCC et \u00e0 la MGCC de r\u00e9soudre leur diff\u00e9rend et \u00e0 la TMCC de d\u00e9livrer les certificats de droits d&#8217;inhumation.<\/li>\n<\/ul>\n\n\n<p class=\"wp-block-paragraph\"><strong>Proc\u00e9dure de recours<\/strong><\/p>\n\n\n<p class=\"wp-block-paragraph\">Les titulaires de licence ont le droit de faire appel des suspensions et des propositions de retrait de licence en demandant une audience aupr\u00e8s du Licence Appeal Tribunal dans les 15 jours suivant la r\u00e9ception d&#8217;un avis ou d&#8217;une proposition.
