Registrar issues Notice of Proposal to Refuse to Renew the licence of a cemetery operator

The Registrar, of the Funeral, Burial and Cremation Services Act, 2002 (the Act), has issued a Notice of Proposal to Refuse to Renew the cemetery operator licence of Husiatner Klaus Beth Israel Cemetery in Toronto (the licensee).

The Registrar has alleged that the cemetery is in contravention of the Act, and that the cemetery is not entitled to licensure because the past conduct of the cemetery board’s manager affords reasonable grounds for belief that the cemetery operations will not be carried on in accordance with the law and with integrity and honesty.

The cemetery board’s manager was served with notice on October 3, 2025. To date, no Notice of Appeal has been served on the Registrar.

Feb. 3, 2026 Update – The licensee filed an appeal after the due date, and a case conference before the Licence Appeal Tribunal is scheduled for February 20, 2026 to determine whether the late application for appeal will be allowed.
May 6, 2026 Update – The Licence Appeal Tribunal has allowed the appeal. The matter will be heard on June 29 and 30, 2026.

Right to a hearing

As per the Act, a licensee is entitled to a hearing by the Licence Appeal Tribunal concerning a proposal by the Registrar to revoke a licence if the applicant or licensee mails or delivers, within 15 days after service of the notice, a written request for a hearing to the Registrar and to the Tribunal.
